Goodbye facebook?

After reading this I decided to take a deep look into the Terms of Use of the site, an found several issues on them that are simply unacceptable.

Find below the “best of” the Terms of Use:
(extracted from here:

1: Under “Terms of Use”
“By using or accessing the Facebook Service, you agree that you have read, understand and are bound by these Terms of Use (“Terms”). We reserve the right, at our sole discretion, to change or delete portions of these Terms at any time without further notice. Your continued use of the Facebook Service after any such changes constitutes your acceptance of the new Terms.”

So: If they change the Terms of Use without further notice, they assume I accept them as well. Good deal for them!

2: Under “Licenses”
“You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof. You represent and warrant that you have all rights and permissions to grant the foregoing licenses.”

So: Facebook keeps the rights to virtually do whatever they want with my data once it has been posted by me! Amazing privacy settings…

And the third:

3: Under “Termination and Changes”
“We may terminate your account on the Facebook Service, delete your profile and any User Content you have Posted on or through the Facebook Service, and/or prohibit you from using or accessing the Facebook Service (or any portion thereof) for any or no reason, at any time in our sole discretion, with or without notice.”

So: no matter what you do, if they decide to kick you out of it, they kick you out of it. Without justification. Without a reason. Without even advice. Wonderful, isn’t it?

I don’t need to read much more, honestly. I found it discouraging. That’s not cool.

Anyone out there willing to re-build an open source based, Facebook-style network, but without such annoying Terms of Use? Let me know about it, you can count me in!

Now, what’s next? The first stunning thing is you can’t just remove all the data and turn off your profile, as they keep the right to save all info a “reasonable amount of time”. You can only deactivate your account.

Ideas? Suggestions? All of them are very very welcome!
